Jussie Smollett Innocent: How Court Testimony Explains the Defense Strategy.

Jussie Smollett Trial

Jussie Smollett was arrested and charged with six counts of Felony Disorderly Conduct. At the root, the charges are six different permutations of lying to police officers. The whole world seems to have decided before the case was even charged that Mr. Smollett was guilty of setting up a fraudulent attack against him by the Osundairo brothers, actors, and personal trainers who went to the Chicago Police department and said they attacked Jussie Smollett.

As a criminal defense attorney, it does not matter if the whole world thinks your client is guilty before the trial starts. And as a juror you cannot consider what the whole world thinks about the Defendant, you have to decide based only on the law and evidence presented to you in the Courtroom.

In the above video, I take the evidence that has been reported (this case has not been live-streamed) and attempt to put together the best argument I can as to why I believe the case against Jussie Smollett has been oversold by the Chicago Police Department and why we should think twice about rushing to say he must be guilty. We also talk a little bit about the bigger picture, why you as a citizen might not want to rush to make lying to the police officers a felony offense. For your reference, go ahead and check out the actual charges leveled against Jussie Smollett here. A special thanks to Megan Crepeau who reported daily a Twitter stream of as much of the questions and answers as she could type out, definitely worth a follow here.
